Noțiunea antecontractului ‒ abordări doctrinare și reglementarea juridică

Abstract

Antecontractul în calitate de act juridic civil, generator de drepturi și obligații, are menirea de a stabili condițiile precontractuale ale contractului viitor. Prevederile Codului Civil modernizat al Republicii Moldova, invocă părților contractante necesitatea de a încheia, inițial antecontractul, ulterior contractul de bază. Oferta de a contracta este proiectată în antecontract, astfel, părțile se asigură că în viitorul apropiat, vor încheia contractul specificat. În prezentul studiu urmează a fi prezentată și analizată noțiunea antecontractului, atât din punct de vedere doctrinar cât și legislativ, totodată fiind expusă și noțiunea proprie a antecontractului.

The pre-contract as a civil legal act, generator of rights and obligations, is intended to establish the pre-contractual conditions of the future contract. The provisions of the modernized Civil Code of the Republic of Moldova, invoke the contracting parties the need to conclude, initially the pre-contract, later the basic contract. The offer to contract is projected in the pre-contract, thus, the parties ensure that in the near future, they will conclude the specified contract. In the present study, the notion of the pre-contract is to be presented and analyzed, both from a doctrinal and legislative point of view, at the same time being exposed the notion of the pre-contract.
