Multiaspectual and comparative analysis of scientific aspects and legal regulations in the matter of criminal tracking body notification

Abstract

The article compares the aspects related to the reporting of criminal offenses and the protection of legal norms. The order of criminal law is ensured by way of compliance, which implies the voluntary compliance by the members of the community of the legal norms imposed by law. The violation of the legal provisions determines the application of the constraint manifested by establishing the appropriate sanctions, by the empowered judicial bodies and the initiation of the criminal trial. The protection of the legal norms and the enforcement of the constraint regarding the persons who have committed crimes is possible only as a result of competent body notification.

În articol sunt analizate comparativ aspectele ce ţin de sesizarea infracţiunilor de ordin penal și protecţia normelor legale. Ordinea dreptului penal este asigurată prin respectare, ceea ce presupune respectarea voluntară de către membrii comunităţii a normelor legale impuse de lege. Încălcarea dispoziţiilor legale determină aplicarea constrângerii manifestate prin stabilirea sancţiunilor corespunzătoare de către organele judiciare abilitate și iniţierea procesului penal. Protecţia normelor legale și aplicarea constrângerii cu privire la persoanele care au comis infracţiuni este posibilă numai ca urmare a notificării organului competent.
