Analiza procesului de arendare a fondului forestier din Întreprinderea Silvică Chișinău în scopul recreativ și perspectivele lui economice și ecologice

Abstract

Actuality and importance of the researched topic.

In this paper I tried to study the process of leasing the forest fund considering that at the moment Government Decision no. 187 of 20.02.2008 "Regarding the approval of the Regulation regarding the allocation of land from the forest fund for the purpose of hunting and/or recreation", the importance of the research theme is undeniable, considering the role of the forest in the economy of a country, and the leasing of the forest fund being a unique phenomenon of its kind and as a result it is liable to be subjected to analysis under legal, economic and ecological aspects.

The object of the research - is the actual process of leasing the forest fund within the Chisinau State Enterprise. Thus, the object of the present study is multifaceted, given the fact that it studies both the importance of the process of leasing the forest fund, as well as the effects of the process from an economic and ecological point of view.

Research methodology.

In order to carry out a successful research, we used a varied range of research methods, which led to the realization of a study on the topic of leasing the forest fund for recreation purposes. Thus, the realization of a complex methodology was manifested through several known forms of scientific research: analysis, deduction, induction, demonstration, argumentation. Direct and indirect observation methods were also used, which contributed to the formation of a clear vision of the field proposed for research.

Concrete results obtained.

As a result of the study, a multilateral analysis of the current situation with the lease of the forest fund transmitted for recreation purposes to the Chisinau Forestry Enterprise was obtained.

The legal basis regulating the process was addressed, all legal relationships (contracts) with the beneficiaries and their transition over time were analyzed. Data were obtained regarding the revenues collected annually as well as those not capitalized as a result of not applying the price changes.

Actualitatea şi importanţa temei cercetate. În această lucrare am încercat să studiez procesul de arendare a fondului forestier având în vedere că la moment este în vigoare Hotărîrea Guvernului nr. 187 din 20.02.2008 „Cu privire la aprobarea Regulamentului privind atribuirea în folosință a terenurilor din fondul forestier în scopuri de gospodărire cinegetică şi/sau de recreere”, importanţa temei de cercetare este incontestabilă, având în vedere rolul pădurii în economia unei ţări, iar arendarea fondului forestier fiind un fenomen unical de felul său și ca urmare este pasibil a fi supus analizei sub aspecte juridice, economice și ecologice. Obiectul cercetării - este procesul propriu-zis de arendă a fondului forestier din cadrul ÎS Chișinău. Astfel, obiectul prezentului studiu este multiaspectual, dat fiind faptul, că se studiază atât importanţa procesului de transmitere în arendă a fondului forestier, cât şi efectele procesului sub aspect economic și ecologic. Metodologia cercetării. Întru efectuarea unei cercetări reuşite, noi am utilizat o gamă variată de metode de cercetare, care au condus la realizarea unui studiu în tematica arendei fondului forestier în scop de recreere. Astfel, realizarea unei metodologii complexe s-a manifestat prin mai multe forme cunoscute de cercetare ştiinţifică: analiza, deducţia, inducţia, demonstrarea, argumentarea. Au fost, de asemenea utilizate şi metodele de observare directă şi indirectă, care au contribuit la formarea unei viziuni clare asupra domeniului propus spre cercetare. Rezultatele concrete obținute. Ca urmare a studiul făcut s-a obținut o analiză multilaterală a situației actuale cu arenda fondului forestier transmisă în scop de recreere pe Întreprinderea pentru Silvicultură Chișinău. Au fost abordată baza juridică ce reglementează procesul, au fost analizate toate raporturile juridice (contracte) cu beneficiarii, şi tranziția în timp a acestora. S-au obținute date privind veniturile încasate anual precum și cele nevalorificate ca urmare a ne aplicării modificărilor de preț.
